Lasting powers of attorney in England and Wales were created under the Mental Capacity Act 2005 of which copies are available online, and came into effect on 16 September 2010. The LPA replaced the former Enduring Powers of Attorney,which were narrower in scope. Their purpose is to meet the needs of those who can see a time ahead when they will not be able – in the words of the Act, will lack capacity, to look after their own personal and financial affairs. The LPA allows them to make appropriate arrangements for family members or trusted friends to be authorised to make decisions on their behalf.The former EPA was simple to administer, but failed to provide for some decisions which may have to be made in circumstances that preclude their being made by the person principally affected. In particular, the attorney's powers under the EPA were largely defined in terms of money and property, and were not related to decisions on medical matters such as the continuation or otherwise of life-sustaining treatment, or welfare matters such as a move to a different kind of accommodation. The primary purpose of the changes under MCA 2009 was to rectify this omission, by creating two LPas,One for property and financial affairs and one for Health and Welfare. The opportunity was also taken to make further changes, whose principal effect was to make the whole apparatus very much more complex, and correspondingly more expensive to administer.The test so defined is decision-specific. It can indicate an answer to the question Can he any longer use a gas ring safely when unsupervised?', but does not allow for wider questions to be given a firm yes/no answer when the real answer is that he has restricted capacity and so can deal with some aspects but not others. As stated in an official summary of the Act, it is 'a single clear test for assessing whether a person lacks capacity to take a particular decision at a particular time.

A loan shark is a person or body that offers unsecured loans at illegally high interest rates to individuals, often enforcing repayment by blackmail or threats of violence.Throughout history, usury laws made loan sharks commonplace. Many moneylenders skirted between legal and extra-legal activity. In the recent western world, loan sharks have been a feature of the criminal underworld, but are less common in law-abiding life.Many customers were employees of large firms, such as railways or public works. Larger organizations were more likely to fire employees for being in debt as their rules were more impersonal, which gave the loan shark a powerful form of blackmail. It was easy for lenders to learn which large organizations did this rather than collecting information on the multitude of smaller firms. Larger firms had more job security and the greater possibility of promotion, so employees sacrificed more to ensure they were not fired. The loan shark could also bribe a large firm's paymaster to provide information on its many employees. Regular salaries and paydays made negotiating repayment plans simpler.The size of the loan and the repayment plan were often tailored to suit the borrower's means. The smaller the loan, the higher the interest rate was, as the costs of tracking and pursuing a defaulter was the same whatever the size of the loan. The attitudes of lenders to defaulters also varied: some were lenient and reasonable, readily granting extensions and slow to harass, whilst others unscrupulously tried to milk all they could from the borrower. Because salary lending was a disreputable trade, the owners of these firms often hid from public view, hiring managers to run their offices indirectly. To further avoid attracting attention, when expanding his trade to other cities, an owner would often found new firms with different names rather than expanding his existing firm into a very noticeable leviathan.

Currency intervention is the buying or selling of currency by central banks in an attempt to manipulate the price of a particular currency.a consumer in the U.S. buys a Chinese product, Chinese manufacturers are paid in US dollars. These U.S. dollars are then deposited in a U.S. bank account. At this point, the Chinese exporter needs to convert dollars into yuan. Through its commercial bank it sells the U.S. dollars to the Chinese central bank, the People's Bank of China. Since the trade between the United States and China does not balance, there is a shortage of yuan and a surplus of U.S. dollars in the Chinese central bank. The usual remedy to this situation used in international trade would be for the Chinese central bank sell its dollars on international currency markets and buy yuan in exchange, resulting in a self-correcting system: the U.S. dollar weakens and the Chinese yuan strengthens, until equilibrium is restored and the trade gap closes.It slows the appreciation of the Yuan, or in some cases effectively pegs the CNY against the USD. The central bank net buys USD, then sterilizes the excess dollar flows by buying dollar-denominated assets, such as U.S. treasuries. This has the effect of keeping the excess dollars out of the currency exchange markets, where they would cause a correction in the exchange rates. Thus, the Chinese central bank manipulates the exchange rates by creating yuan and buying U.S. debt. This "printing" of Chinese Yuan by the central bank is not without consequence, however, since in excess if yuan are created faster than domestic economic output) it would eventually lead to inflation, causing consumer prices to rise. Economist Paul Krugman writes that by keeping its currency artificially weak China generates a dollar surplus.

Commercial paper is a money-market security issued sold by large banks and corporations to get money to meet short term debt obligations (for example, payroll), and is only backed by an issuing bank or corporation's promise to pay the face amount on the maturity date specified on the note. Since it is not backed by collateral, only firms with excellent credit ratings from a recognized rating agency will be able to sell their commercial paper at a reasonable price. Commercial paper is usually sold at a discount from face value, and carries higher interest repayment rates than bonds. Typically, the longer the maturity on a note, the higher the interest rate the issuing institution must pay. Interest rates fluctuate with market conditions, but are typically lower than banks' rates.Commercial paper is a lower cost alternative to a line of credit with a bank. Once a business becomes established, and builds a high credit rating, it is often cheaper to draw on a commercial paper than on a bank line of credit. Nevertheless, many companies still maintain bank lines of credit as a "backup". Banks often charge fees for the amount of the line of the credit that does not have a balance. A money market fund also known as money market mutual fund is an open-ended mutual fund that invests in short-term debt securities such as US Treasury bills and commercial paper. Money market funds are widely though not necessarily accurately regarded as being as safe as bank deposits yet providing a higher yield. Regulated in the US under the Investment Company Act of 1940, money market funds are important providers of liquidity to financial intermediaries.Money market funds in the US created a loophole around Regulation Q, which at the time prohibited demand deposit accounts from paying interest and thus money market funds can be seen as a substitute for bank accounts.Outside of the U.S., the first money market fund was set up in 1968 and was designed for small investors. Foreign Exchange Market Turnover As per the Triennial Central Bank Survey by the Bank for International Settlements on “Foreign Exchange and Derivatives Market Activity”, global foreign exchange market activity rose markedly between 2009 and 2010. The strong growth in turnover may be attributed to two related factors. First, the presence of clear trends and higher volatility in foreign exchange markets between 2001 and 2004 led to trading momentum, where investors took large positions in currencies that followed persistent appreciating trends. Second, positive interest rate differentials encouraged the so-called “carry trading”,investments in high interest rate currencies financed by positions in low interest rate currencies. The growth in outright forwards between 2009 and 2010 reflects heightened interest in hedging. Within the EM countries, traditional foreign exchange trading in Asian currencies generally recorded much faster growth than the global total between 2009 and 2010. Growth rates in turnover for Chinese renminbi, Indian rupee, Indonesian rupiah,Korean won and new Taiwanese dollar exceeded 100 per cent between April 2009 and April 2010. Despite significant growth in the foreign exchange market turnover, the share of most of the EMEs in total global turnover.

Market Efficiency With the exchange rate primarily getting determined by the forces of demand and supply, the issue of foreign exchange market efficiency has assumed importance in India in recent years. Markets are perceived as efficient when market prices reflect all available information, so that it is not possible for any trader to earn excess profits in a systematic manner. The efficiency/liquidity of the foreign exchange market is often gauged in terms of bid-ask spread. The bid-ask spread reflects the transaction and operating costs involved in the transaction of the currency. These costs include phone bills, cable charges, book-keeping expenses and trader salaries, among others. In the spot segment, it may also include the risks involved in holding the foreign exchange. These costs/bid-ask spread are expected to decline with the increase in the volume of transactions in the currency. The finance theory identifies three basic sources of bid-ask spreads: (a) order processing costs, (b) inventory holding costs, and (c) information costs of market making, and each one is influenced by trading volume in a particular manner (Hartmann, 1999). The low and stable bid-ask spread in the foreign exchange market, therefore, indicates that market is efficient with underlying low volatility, high liquidity and less of information asymmetry.

An analysis of the complexities, challenges and vulnerabilities faced by EMEs in the conduct of exchange rate policy and managing volatilities in foreign exchange market reveal that the choice of a particular exchange rate regime alone cannot meet all the requirements. The emerging consensus is that for successful conduct of exchange rate policy, it is essential for countries to pursue sound and credible macroeconomic policies so as to avoid the build-up of major macro imbalances in the economy. Second, it is essential for EMEs to improve the flexibility of their product and factor markets in order to cope and adjust to shocks arising from the volatility of currency markets and swings in the terms of trade in world product markets. Third, it is crucial for EMEs to develop and strengthen their financial systems in order to enhance their resilience to shocks. In addition, a sound and efficient banking system together with deep and liquid capital market contributes to the efficient intermediation of financial flows. This could help prevent the emergence of vulnerabilities in the financial system by minimising unsound lending practices that lead to the build-up of excessive leveraging in the corporate sector and exposure to foreign currency borrowings. Fourth, countries would need to build regulatory and supervisory capabilities to keep pace with financial innovations and the emergence of new financial institutions’ activities, and new products and services, which have complicated the conduct of exchange rate policy. Fifth, policy makers need to promote greater disclosures and transparency.

The evolution of India’s foreign exchange market may be viewed in line with the shifts in India’s exchange rate policies over the last few decades from a par value system to a basket-peg and further to a managed float exchange rate system. During the period from 1947 to 1971, India followed the par value system of exchange rate. Initially the rupee’s external par value was fixed at 4.15 grains of fine gold. The Reserve Bank maintained the par value of the rupee within the permitted margin of ±1 per cent using pound sterling as the intervention currency. Since the sterling-dollar exchange rate was kept stable by the US monetary authority, the exchange rates of rupee in terms of gold as well as the dollar and other currencies were indirectly kept stable. The devaluation of rupee in September 1949 and June 1966 in terms of gold resulted in the reduction of the par value of rupee in terms of gold to 2.88 and 1.83grains of fine gold, respectively. The exchange rate of the rupee remained unchanged between 1966 and 1971.
